EASTLAKE CITY COUNCIL, REGULAR COUNCIL MEETING MINUTES OCTOBER 8, 2013
The Regular Meeting of the Eastlake City Council was held at Eastlake City Hall, 35150 Lakeshore Boulevard. The Meeting was called to order by Council President Mr. Morley at approximately 7:02 p.m.
The Pledge of Allegiance was led by Mr. D’Ambrosio.
ATTENDEES
Members of Council in attendance were Mr. D’Ambrosio, Mr. Licht, Mrs. Quinn-Hopkins, Ms. Vaughn, Ms. DePledge, Mr. Hoefle and Council President Mr. Morley. Also attending was Council Clerk Mrs. Cendroski.
Those attending from the Administration were Mayor Andrzejewski, Law Director Klammer, Finance Director Slocum, Service Director Semik, CBO McReynolds, and Fire Chief Whittington. City Engineer Gwydir was absent and excused.
APPROVAL OF MINUTES
Regular Council Meeting – September 24, 2013
MOTION: Ms. Vaughn moved to approve the minutes of the Regular Council Meeting of September 24, 2013. Mr. Licht seconded.

COUNCIL PRESIDENT’S REPORT – Mr. Morley
Meetings Scheduled
Mr. Morley: The next Council-as-a-Whole Committee Meeting is scheduled for Tuesday, October 22, 2013 at 7:00 p.m. The Regular Council meeting will be convened immediately following the adjournment of the Council-as-a-Whole Committee meeting.
COMMUNICATIONS & PETITIONS
A communication was received from the Administration and Police Chief Reik requesting an amendment to City Ordinance Section 751.07 “Inspection before Licensing Vehicles; Rules.” This was referred to Ordinance Committee.
A communication was received from the Administration regarding repairs to the Fire Department roof. This was referred to Finance Committee.
A communication was received from the Administration regarding the Lease Agreement between the City of Eastlake and the Jean Chase Memorial Fund, Inc. This was referred to Finance Committee.
A Fee Waiver Request was received from Eastlake Cub Scout Pack 83 for use of the
Community Center on Sunday, October 13, 2013 for a Fall Hot Dog Roast. Mr. Morley stated Council has received this information. If there are no objections Mr. D’Ambrosio will make a Motion to approve this request.
There were no objections.
FEE WAIVER REQUEST
Mr. D’Ambrosio moved to approve the Fee Waiver Request for Eastlake Cub Scout Pack 83 for use of the Community Center on Sunday, October 13, 2013 from 1:00 p.m. to 4:00 p.m. Ms. Vaughn seconded.
ROLL CALL: Yeas unanimous.
Motion carried. The Fee Waiver Request for Eastlake Cub Scout Pack 83 is approved.
COMMITTEE REPORTS
Mr. Morley: No Committee meetings were held.
Finance Committee – Ms. Vaughn, Chair
Ms. Vaughn: I would like to schedule a Finance Committee meeting for Tuesday, October 15, 2013 at 6:00 p.m. At that point in time we will be discussing the re-appropriation issues, the repairs to the Fire Department roof and a large overpayment to the City in February which will cause some revenue adjustments for the end of the year. I cannot give you more information because all of the taxes are not available – hopefully Mr. Slocum will have them by the meeting. I have nothing further to report.
Economic & Community Development Council – Mrs. Quinn-Hopkins, Chair
Mrs. Quinn-Hopkins: An Economic & Community Development Council meeting is scheduled for Wednesday at 6:30 p.m.
Ordinance Committee – Mr. Hoefle, Mr. D’Ambrosio – Co-Chairs
Mr. Hoefle: An Ordinance Committee meeting is scheduled for Tuesday, October 15, 2013 in conjunction with the Finance Committee meeting.
Eastlake Port Authority Liaison – Ms. DePledge
Ms. DePledge: The Eastlake Port Authority will be meeting tomorrow evening, October 9th at 7:00 p.m. in the conference room down the hall.
Zoning Board of Appeals Appointment
Mr. Morley: Mrs. Balog-Tucker is in the audience. She is Council’s appointment to the Zoning Board of Appeals and will be taking the place of Mr. Kenneally. Her first meeting with the ZBA will be tomorrow. We appreciate her coming forward and applying for the position.
RECOGNITION OF THE PUBLIC
Mr. Morley recognized the public input at this time; he reminded the speakers that there is a 3-minute limit for their comments; all comments are to be directed to the Chair and not include any personalities or individuals.
Yvonne Marn, 272 Heather Lane, Eastlake
Ms. Marn: This has to do with the traffic light that is at S.R. 91 and Lakeshore Blvd. I get the sign we have that says you must have a full stop when it is red. It is when you have the red light and the green arrow – there are problems with that. I was told per police officers here that you have to come to a full stop and then turn and people are coming behind you and are ready to kick you in the butt. My brother was over one day and he had an issue there – he called the police dispatcher and he was told not to stop – to go because he was going to get hit. Which way is it?
Mayor Andrzejewski: That is under the control of the Village of Timberlake.
Ms. Marn: Should I call them?
Mayor Andrzejewski: Yes. My opinion is – and you need to understand that we have researched this – the Village of Timberlake owns both the east and west side of Lakeshore Blvd. The City of Eastlake takes over 50 feet from the center line which is just before the iron rail fence at the Croatian Home. Timberlake actually owns the sign too. We asked why they were ticketing people on the south side of Lakeshore – and I confirmed this with State Representative Rogers –the Village of Timberlake owns that entire intersection.
Ms. Marn: Did they place the stop on red sign there?
Mayor Andrzejewski: I did that to help our residents. I have always gone through on the green arrow on red and never had a problem. You should verify it with Timberlake. We put the sign up because they are using Eastlake residents to fund their police department. They are waiting there for people to come to a jack rabbit stop and ticket them. So I put up a sign that says come to a complete stop. I also suggested on Channel 12 – I count to 5 and that way I know if they ever stop me I can say it was red and I counted to five and then went on. You need to call the Village of Timberlake. They control that entire intersection.
Ms. Marn: I stop and then I go. It is the same thing you would do with a red light. I was wondering if they are going to have the red light with the arrow can you eliminate the arrow?
Mayor Andrzejewski: You have to talk to Timberlake. We could not do it if we wanted to. It is their stop light.
Ms. Marn: Then I will call them.
Chief Whittington: I believe – and you can confer with the Law Director – the light is green – you should be able to go through a green light. The green arrow tells you to go through. I think you are saying if you have the arrow you can proceed – I think that is legal.

Chief Whittington: The green arrow is telling you that you can go through the intersection. If you come to an intersection and the light is red but has a green arrow you do not have to stop.

Chief Whittington: There may be some confusion. If you come to that intersection northbound and the light is red and the arrow is green you do not have to stop for the intersection if you are turning right. That arrow is giving you permission to turn right.

Chief Whittington: I think there is some confusion. The Timberlake police officers were parking at Walden and Lakeshore. They would watch that intersection and were looking for the rolling stops. They can tell when you no longer have the arrow. That is what they were ticketing people for. Once the arrow is gone and it is red then you have to come to a complete stop. As long as the arrow is green you do not have to stop.

John Crissey, 35755 Lakeshore Blvd., Lot 20, Eastlake
Mr. Crissey: I came to ask about the scraping times – between 7:00 p.m. and 9:00 p.m. I take care of my 81 year old mother and lots of times she is not able to go out with me and it presents a problem because I am not able to go unless I hire someone to take care of her while I am gone which makes it not worth my while to go out or I wait until she is asleep and then go because I cannot leave her alone when she is up. She is in a wheel chair and has had a few strokes. I was wondering if you had come to any conclusion about setting the times up where we can stay out?
Mr. Morley: We have talked about this – Mr. D’Ambrosio just wrote another article about in for the Gazette.
Mr. D’Ambrosio: I just wrote another article for the Gazette. I did talk to quite a few residents that actually introduced this. They are happy with the way the restrictions are now. In my article I am looking to see what kind of feedback I get because it seems like the majority of people I spoke to are happy with the restrictions. You are the second person I have heard of who had an objection. If you provide me with your email address after the meeting I can notify you of what I find out.

ADMINISTRATIVE REPORTS:
MAYOR/SAFETY DIRECTOR – Ted Andrzejewski
Mayor Andrzejewski: I have nothing to report.
LAW DIRECTOR – Randy Klammer
FINANCE DIRECTOR – Mike Slocum
Due to a malfunction with the recorder the reports of Mr. Klammer and Mr. Slocum were skipped and not available for transcribing. Mr. Semik’s report was recorded mid-progress.
SERVICE DIRECTOR – Mike Semik
Mr. Morley: Mr. Semik, will the trees that are being removed on Erieview during the road
repairs be replaced?
Mr. Semik: There will be no new trees.
Mr. Morley: The trees are coming out so the equipment can get down the street?
Mr. Semik: That is correct.
Mr. D’Ambrosio: Have you made it to Freed as far as flushing out the sewers and mains?
Mr. Semik: We have been over there. I will have to take a look at the work log.
Mr. D’Ambrosio: Also, Grovewood.
Mr. Semik: I will see what streets they have been on.
Mr. Hoefle: In regards to the top soil that is from the stadium and is located at the soccer fields – I had a resident who has asked – he has a friend who has a front end loader and a dump truck – he wants to put some in this backyard. I saw your recent email about no contractors. He is not a contractor and wants to put the soil in his backyard to help with some water areas. Is there any problem with his friend helping him?
Mayor Andrzejewski: No, there isn’t. How big is the dump truck?
Mr. Hoefle: One-ton.
Mr. Semik: We set this up so everyone would get a shot at it. I have no objection as long as it is an Eastlake resident. My concern is that everyone has an equal opportunity.
Mayor Andrzejewski: Here is our concern – and it has not happened so I am very pleased with it. We wanted to make that good soil available to as many Eastlake residents as possible. We wanted to avoid landscapers and contractors bringing big dump trucks and using it for their businesses. If it is a pickup truck – fine. There is so much dirt there. As long as it is not an 8-ton dump truck.
Mr. Hoefle: He just wants to fill in the low area of his yard.
Mayor Andrzejewski: There is plenty of dirt there. Take it. That is what it is there for.

CITY ENGINEER – Tom Gwydir
Mr. Gwydir was absent and excused.
CHIEF BUILDING OFFICIAL – James S. McReynolds
Mr. McReynolds: The Advance Auto Store that took over the old Sears Hardware is slated to open. We granted their certificate of occupancy and they are stocking shelves – they should have an opening in the next week or two. Down the street from there on Vine Street is a new hair cutting place called Magic Scissors – they are nearing their completion and hope to open in about two weeks. We also have a new house being built on Lakeshore around East 336th Street. It is being framed and even though it is going along well the completion date is still 4 months away. Thank you.
Mr. Klammer: Mr. McReynolds has spent a lot of time going through the trailer issue – the one in the guy’s yard. There are notice provisions that must be followed – we have a little more time.
Mr. Morley: Mr. McReynolds, I appreciate the communication since you have been here. We all appreciate it. We have been hearing good things from contractors so keep up what you are doing.
POLICE CHIEF – Larry Reik
Chief Reik was absent and excused.
FIRE CHIEF – Ted Whittington
Chief Whittington: We had a pretty sick lady the other day on Lakeshore Blvd. and Mr. Evers stopped and rendered some care before we could get over there. I know he is always here and I appreciate his efforts – it helps. We got another grant from the Willoughby Elk’s in the amount of $500 for smoke detectors. I will be working with them and will forward it to the Mayor’s office. I am open for questions.

MOTION TO APPOINT SPECIAL PROSECUTOR
Mr. D’Ambrosio moved to appoint Mark Schneider, Esq. as Special Prosecutor for the City of Eastlake. Ms. Vaughn seconded.
