COUNCIL AS A WHOLE COMMITTEE MEETING

MINUTES

TUESDAY

OCTOBER 24, 2017

7:00 P.M.

Mr. Hoefle opened the meeting at 7:00 p.m.

ATTENDEES

Members of Council in attendance were Mr. Zuren, Mr. Meyers, Mr. Kasunick, Mr. Spotton, Mr. Evers and Mr. Hoefle. Also attending was Council Clerk Mrs. Simons.  Council President Ms. DePledge was absent and excused

Those attending from the Administration were Mayor Morley, Fire Chief Whittington, CBO Menn, Service Director Rubertino, City Engineer Gwydir and Law Director Klammer.  Police Chief Reik and Finance Director Schindel were absent and excused. 

Mr. Hoefle: If there is anyone privately recording this meeting as courtesy to the public will you please identify yourself so that the fellow attendees know that they are being recorded.  Seeing none this meeting is being recorded by the City of Eastlake.

LEGISLATION PROPOSED:

10-24-(01): Ordinance: Amending Chapter 770 formerly “Medical Marijuana Cultivation and Processing Licensure,” now entitled “Medical Marijuana Licensure.”

Mr. Hoefle: Mayor Morley or Mr. Klammer?

Mr. Klammer: Yes this was the amendment to add the dispensary opportunity here, so we added a whole new set of regulations.  Including some building related matters to keep it more of a clinic as opposes to what you might see as a head shop or something like that.  Have it more like a pharmacy or a clinic.  Buckeye Relief had some input as well, because they would be a candidate for this.  So they are aware of those conditions also.  There were a couple of comments that came up at the Committee Meeting that I looked at further.  On the question of who can revoke obviously the ultimate is the Safety Director, but it goes to the Zone Board of Appeals.  My analysis was that you got to have a pre-deprivation hearing before you revoke licenses in general.  That is going to be a lag there should the Mayor determine that a revocation or suspension is necessary.  So there is going to be a bit of a lag there that I think that we just have to live with.  I don’t anticipate there being any big problems.  Councilman Meyers had a comment about some states allowing delivery of medical marijuana and I don’t think that Ohio allows that, but unfortunately our ordinance requires…this proposal requires that all of the sales be done within the facility anyways so that covers his concerns as well.  If there are any questions I am here.

LEGISLATION PENDING:

There was no Legislation Pending.

MISCELLANEOUS:

Ordinance: To reappropriate for the expenses beginning on January 1, 2017 and ending on December 31, 2017.

Mr. Hoefle:  We will need a Motion to add it to the agenda and it will be Legislation No.: 10-24-(02).  Mayor Morley?

Mayor Morley: Finance Director Schindel left me some information on the changes.  We had an increase in receipts through R.I.T.A.; therefor our increase of our collection fees will go up.  So that is what the adjustment is and then we will have a potential refund after all of that is done.  On the transferred debts service we did have as much money as we anticipated for the stadium parking, so that was the other change there.  Under Special Revenue we are asking for another $25,000.00 for basin work through the Stormwater, which is through the County.  So we need to change that.  We got D.A.R.E. grant and that is the $2,000.00 and then the Senior Center Fund receipts increased by $3,000.00 with our membership and donations with all of the things that have been going on in the city.  She had to change that and those are all of the changes.
