COUNCIL AS A WHOLE COMMITTEE MEETING

MINUTES

TUESDAY

June 28, 2016

 

Council President Ms. DePledge opened the meeting at 7:00 p.m. 

ATTENDEES

Members of Council in attendance were Mr. Zuren, Mr. Meyers, Mr. Kasunick, Mr. Spotton, Mr. Evers, Mr. Hoefle and Council President Ms. DePledge. Also attending was Council Clerk Mrs. Simons. 

Those attending from the Administration were Mayor Morley, Fire Chief Whittington, CBO Menn, Service Director Rubertino, City Engineer Gwydir and Finance Director Schindel. Police Chief Reik and Law Director Klammer were absent and excused.

LEGISLATION PROPOSED:

There was no Legislation Proposed.

LEGISLATION PENDING: (Placed on first Reading on June 14, 2016)

06-14-(05): An Ordinance to amend Section 1385.99 of the Codified Ordinances.

06-14-(06): An Ordinance to amend Section 1387.99 specifically Subsection (b) of the Codified Ordinances.

Ms. DePledge: We briefly discussed these at the last meeting and we decided to put them on second reading. To give Mr. Menn an opportunity to address these changes with Council and to see if Council had any questions for him before we move them forward. Mr. Menn could you please give us a background on these two ordinance changes? 

Mr. Menn: Thank you and the reason why we decided to do this…I was talking with Law Director Klammer. We have had a few housing cases that went to…the way that they were being charged…what it came down to is that they were allowed to have a court appointed attorney.  We had to change these offenses to read with the minor misdemeanor that it does not allow a court appointed attorney.  When they have a court appointed attorney the city is responsible for paying for that fee.  It still gives us a leeway that if it is a case that has to be charged further we still have the right to do that with the first degree misdemeanor. 

Mayor Morley: Mr. Menn said it correctly that if we keep going…they start getting public defenders and it just keeps racking up the cost for the city. We are trying to avoid that.  We don’t want to drop some of the cases that have been dropped for certain reasons.  This is the way to do that and to get done what we need to get done on it, especially with our property maintenance problems.
