COUNCIL AS A WHOLE COMMITTEE MEETING
MINUTES
TUESDAY
FEBRUARY 27, 2018
7:00 P.M.

Mr. Meyers opened the meeting at 7:00 p.m.

ATTENDEES
Members of Council in attendance were Mr. Kasunick, Mr. Spotton, Mr. Hoefle, Mr. Evers, Mr. Overstreet, Mr. Zuren and Council President Mr. Meyers. Council Clerk Mrs. Simons was absent and excused.

Those attending from the Administration were Mayor Morley, Fire Chief Whittington, Police Chief Reik, Service Director Rubertino, City Engineer Gwydir, Finance Director Schindel and Law Director Klammer. CBO Menn was absent and excused.

Mr. Meyers: If there is anyone privately recording this meeting as courtesy to the public will you please identify yourself so that the fellow attendees know that they are being recorded. Seeing none this meeting is being recorded by the City of Eastlake.

LEGISLATION PROPOSED:
1. Ordinance: To reappropriate expenses for the of the City of Eastlake, State of Ohio, for the period beginning January 1, 2018 and ending on December 31, 2018.
Mr. Meyers: This will be placed on First Reading.

There were no questions at this time.

LEGISLATION PENDING:
1. 02/13/03: Ordinance: Enacting Chapter XXX Titled “Canvassers and Solicitors.”
Mr. Meyers: We will need a Motion to remove this from tonight’s agenda.

MISCELLANEOUS:
1. Resolution: To enter into a contract with CTM, LLC for the replacement of the damaged telecommunications system.
Mr. Meyers: This will be Legislation No.: 02-27-(01).

2. Ordinance: To enact Section 741.23 “Do Not Knock Registry”.
Mr. Meyers: This will be Legislation No.: 02-27-(02). Ms. Schindel would you like to comment on the communication system?

Ms. Schindel: Thank you. We are still working with the insurance company in terms of trying to come to an agreement…I have three different quotes that you have received in your packages. We did not go out for bid, because at that point in time…but we are not sure at this point in time how much if not all of the telephone bill they are not paying. We are still working with them on it but we really need to get the phone systems and it’s time to move on. So with those three quotes that I’ve received I looked at two of the people had done various work…in the past so they were familiar with the system and the other one was someone that had come in because of the 9-1-1 and dispatch…this quote. I would like to use the one that is actually…in terms of service as well as a system and to move forward with a phone system in place.

Mr. Meyers: Mr. Klammer do you wish to comment on the “Do Not Knock Registry?”

Mr. Klammer: If you do recall we have a whole new chapter…we have a canvassers and solicitors chapter so if you remember from the last meeting what I wanted to make sure that there weren’t any problems. Ours actually had a few more then the one that you were proposing…so what I did is that I propose it as a new section to our existing Ordinance 741.23. There have been some emails and questions about how are we going to talk to the residents…the First Amendment issues and it is something that I think the Mayor will post it on Facebook or the city’s website to explain to the residents that this covers everything so that is your First Amendment privileges and charitable organizations as well. That is going to happen know what we can put no solicitation signs on that they are expecting everybody not to show. You are going to have those kinds of hiccups…that’s natural.

Mayor Morley: Once legislation is passed I’ll have NOPEC come in and we will have them in the Town Hall for so the residents can come in and they will be able to sign up online or sign up at City Hall. We will send out post cards and once they sign up and they will explain. I know that everyone sends some emails and some of the concerns with the non-profit, politicians coming to the doors they will still be able to do that. Some people will probably call us and Councilman Spotton said that some will call the Police and one of the things that will…permits anytime the solicitors have into the Police Department for the permits and obviously we will stop giving out permits, so if anyone calls we are going to know that they don’t have a permit for the non for profit form.

Mr. Klammer: Just so you guys have it and in case you get questions on it remember to keep the context is important, because the only reason any of the First Amendment issues become a question is that we are passing legislation. That doesn’t mean that somebody can’t put no trespassing or no solicitation sign in their yard, whether you’re a politician or not they want you off of their yard. It’s just that we can’t pass a regulation and Police take a law enforcement action based on our regulations, because of the First Amendment privacy we can’t not…that doesn’t mean that somebody can’t say get off of my yard. The politicians and the campaigners they still have to be mindful of that and although we can’t pass an ordinance that says that you can do it the resident still has a right to tell you to get off of their yard. Everybody needs to understand the context of canvassers.
