Committee Chair Mr. Hoefle opened the meeting at approximately 6:00 ­­­p.m. Members of the Committee in attendance were Mr. Hoefle, Mr. Evers and Mrs. Quinn-Hopkins. Present from Council were Mr. Licht, Ms. DePledge and Council President D’Ambrosio. Ms. Vaughn was absent and excused.

In attendance from the Administration were Mayor Morley, Police Chief Reik and Finance Director Slocum.

Also in attendance were members of the public.  

 

AMENDMENT:

section 333.03 “Maximum Speed Limits: assured clear distance ahead”

Mr. Hoefle: Chief Reik?

Chief Reik: In our speed ordinance there is a different subsection for each area – school zones, residential, S.R. 91, Lakeshore Blvd. and the freeway. The freeway was recently updated when the freeway changed. Lost Nation, of which we still have a portion, is the only one not specifically addressed in the ordinance. If a speeding ticket is written on Lost Nation it has to be written under a State code which means all the fines go to the State. One of the newer guys noticed this omission and brought it to my attention. We don’t specifically target out there but we do have a resident on Lost Nation between Laura and Delores who calls us if he thinks traffic is getting high and just like everywhere else we would try to do some speed controls in that area. When we do get a speeder there it would be more beneficial to write a ticket under City codes so we could get the fines that are collected from the violator.

Mr. D’Ambrosio: We will put this under 35 mph. We are not changing the speed limit on that street.

Chief Reik: That is correct. The rest of Lost Nation which is all Willoughby is 35 mph with the exception of their school zone.

Mr. D’Ambrosio: Like you said, we are not doing this just to target the area – nothing will really change. We are just making it so if we do write a ticket there the money will come to the City.

Chief Reik: Correct.

Upon review the Committee agreed to move this matter forward to the next regular Council meeting.

MISCELLANEOUS

SECTION 939.26(d)(3)

Mr. Hoefle: This was requested by the WPCC and is a housekeeping matter and is done annually. Willoughby has already approved the legislation regarding the increase in the surcharge fees. Are there any questions from the Committee or Council?

Mrs. Quinn-Hopkins: I am having a hard time justifying this to be an emergency. This is involving money and when it is involving money I have a problem voting it through as an emergency.

Mr. Hoefle: Your comments are noted. Anyone else have any comments?

The Committee agreed to move this matter forward to the next regular Council meeting.

Mrs. Quinn-Hopkins: I would agree to move this forward but I cannot justify this as an emergency. I am not saying we should not do it but not as an emergency.

Ms. DePledge: What is the effective date – when do the increases go into effect?

Mr. Hoefle: April 4^th.

Mayor Morley: It does not have to be read as an emergency – you can just have three meetings in a row.

Mr. D’Ambrosio: I am not too concerned about it for five cents.

Mr. Hoefle: It is a housekeeping matter and has been done every year.

Mrs. Quinn-Hopkins: Willoughby has already approved it.

Mr. Licht: If this is part of the agreement and it is a joint agreement – if we don’t pass it does it mean that Willoughby’s will not go into effect. I don’t know if this is part of the joint agreement where both parties are required to agree of if one is separate from the other. To me it looks identical to Willoughby’s. If we don’t pass it then Willoughby’s is pending too. I don’t’ know if that is right.

Mr. Slocum: My understanding is if we do not pass it – or until we pass it – the other charges will remain in effect.

Ms. DePledge: The increases will be owed back to the effective dates so they will have to pay a lump sum back to the effective date.

Mr. Slocum: I don’t know if they will owe back and I have not seen the ordinance but this is covers the extra strength corrections they have to do when they find someone is discharging more garbage into our network.

Mr. Hoefle: This is for businesses only.

Ms. DePledge: It does not affect the residents.

Mrs. Quinn-Hopkins: Businesses in our community pay this.

Mr. Slocum: Yes, but there are very few businesses that actually get billed for this. Lucio’s, Anthony’s – those are the two that stick out in my mind that actually get billed these charges. There are very few that do get billed.

Ms. DePledge: I think the Committee decided to move this forward?

Mr. Hoefle: Yes, we recommend moving this forward.
