ORDINANCE COMMITTEE MEETING

JUNE 16, 2015

 

 

Committee Chair Mr. Hoefle opened the meeting at approximately 6:00 ­­­p.m. Members of the Committee in attendance were Mrs. Quinn-Hopkins, Mr. Evers and Mr. Hoefle. Present from Council were Ms. Vaughn, Mr. Licht and Council President D’Ambrosio. Ms. DePledge was absent and excused.

 

In attendance from the Administration were Mayor Morley and CBO Menn. Fire Chief Whittington was late in arriving.

 

Also in attendance were members of the public.

 

NEW ENACTMENT:

CHAPTER 769 “DONATION/RECYCLING BINS”

Mr. Hoefle:  Mayor Morley?

 

Mayor Morley:  We have had some calls over the past six months and have also received calls about issues on Vine Street.  I asked the Council Clerk to poll communities and got legislation from six or seven communities – Parma, Oakwood Village, etc.  We put a piece of legislation together which we felt best fit in with our City. CBO Menn and both Chiefs reviewed it.  Chief Reik had a commitment this evening but had no issues with this legislation.

 

Mr. D’Ambrosio:  I see they will only be allowed in the B-1 zoning districts. How will you address the ones that are outside of B-1?

 

Mayor Morley:  I have driven around – as well as CBO Menn – to see what business is affected. We will visit those businesses and talk to them and copy all the names on the boxes for notification.  We will give the ones outside of the B-1 district a time frame to remove them.  We will notify the ones on Vine Street that they have to register.  A couple of the issues we had on Vine Street was behind the old Blockbuster – it is a book recycling bin and books are laying all over the ground.  We will call them and they will come and get the books but it is something that has to be addressed.  During my time on Council and as Mayor there have been instances when the bins just look trashy because they are not maintained.  The schools and church properties are covered under this. 

 

Mrs. Quinn-Hopkins:  There was a bin at the corner of Erie Road and Lakeshore Blvd. and it was constantly over filled with stuff.  I personally called the company and asked them to bring a second bin to accommodate the mess.  In that particular case they truly need to have more than one bin there.  I said to either bring a bigger one or add another.  Since there have been two there has been no overflow.  That is a case in point where we really needed more than one in that spot.

 

Chief Whittington joined the meeting at this time.

 

Mr. Evers:  If they would empty the bin like they are supposed to there would be no mess.  It sits there for a week at a time without being emptied.  That is the purpose of this ordinance.  That they have to come pick them up.

 

Mrs. Quinn-Hopkins:  It was filling very quickly – in a day or two.

 

Mr. Evers:  It is their responsibility to come out and empty it.  It is not ours to tell them to clean it up.

 

Mrs. Quinn-Hopkins:  I am thinking that we should allow maybe two bins. The legislation says only one but I guess I would have to suggest no more than two.

 

Mr. Menn:  When I first started here one of the first things I said to the Mayor was that there were bins everywhere – out in the open and a mess.  Most cities do have some kind of requirement.  Where I came from had a Board of Zoning requirement for a permit and it would be reviewed yearly.  You add one and they put two and then three.  I think one is plenty if they maintain it like they should.

 

Mrs. Quinn-Hopkins:  There are more recycling bins around now than at that particular time. What is the one on the First Energy property?

 

Mayor Morley:  This comes down to the one issue down the street.  I let them put it there to take care of the other issue where the main problem is on Lakeshore Blvd.  The person never removed the other bin.  That will be one we will call to have removed.  All the bins on Lakeshore Blvd. will be gone.  They will be only allowed on Vine Street. I will go with whatever everyone wants.  I am okay with two.  I know Mr. Menn would like it at one.

 

Mr. D’Ambrosio: How often are they typically scheduled to be emptied?

 

Mayor Morley:  We will pattern our application after Oakwood Village’s. It includes all information – I.D., tax exempt status, addresses, size and location.

 

Mr. D’Ambrosio:  Does it have frequency of emptying?

 

Mayor Morley:  No, Mr. Menn can ask them their schedule.  Now, with going with a fee they may all back out.  Our fee covers Mr. Menn checking them out.

 

Ms. Vaughn:  Churches and schools are exempt?

 

Mayor Morley: Yes.

 

Mr. Hoefle:  Committee, shall we move this forward?  I make the recommendation we move this forward as is.

 

Mr. Evers: Move forward as is.

 

Mrs. Quinn-Hopkins: Yes.

MISCELLANEOUS

TETHERING ORDINANCE

Mr. Evers: I have had residents call requesting information on where we are with the tethering ordinance.

 

Mr. Hoefle: The information has been forwarded to the Law Director for review.

 

Mr. Evers: I understand you are the driving force behind that – thank you.

 

Mr. Hoefle:  Ms. Vaughn has been helping as well.
