ORDINANCE COMMITTEE MEETING

MARCH 31, 2015

 

 

Committee Chair Mr. Hoefle opened the meeting at approximately 6:50 ­­­p.m. Members of the Committee in attendance were Mr. Evers, Mrs. Quinn-Hopkins and Mr. Hoefle. Present from Council were Ms. DePledge, Ms. Vaughn, and Council President D’Ambrosio. Mr. Licht was absent and excused.

 

In attendance from the Administration were Mayor Morley and Law Director Klammer.

 

Also in attendance were members of the public.   

 

NEW ENACTMENT

SECTION 125.13 “NON-COMPETITIVE BID PROCEDURE FOR THE SALE OF PUBLIC REAL PROPERTY NOT NEEDED FOR ANY PUBLIC PURPOSE”

Mr. Hoefle:  Mayor Morley?

 

Mayor Morley:  This was discussed before – the need for a provision in case we have someone who is interested in property like the NIKE site as this is the property that has been looked at the most.  I spoke with the Law Director about the bid procedure and what would happen if a broker or real estate agent who was interested in the NIKE site contacted us.  This ordinance would permit us to have economic development right then and there instead of going out for bids and continuing to extend the time frame and therefore not being able to develop.

 

Mr. Klammer: We are home rule and have the authority to do this. We do not have a lot of pieces of property we would be thinking about selling.  The Clerk did a good job and included the language about appraisals. I added a provision that indicates you would go to three readings.  You can still pass it as an emergency but the three readings would provide three notices to the public so if anyone had any complaints they would see the agenda and be able to come in and challenge – even a potential buyer could come in and offer to give us more. I thought this was the fair way.  Theoretically you could waive the provision as it is only an ordinance but at least it is in there  suggesting to you that is the policy we recommend.

 

Mr. Hoefle: The legislation looks really nice – cut and dry.  It is really good.

 

Mr. Klammer:  Thank you to the Clerk.

 

Mayor Morley: Mrs. Cendroski did a good job. We keep having more and more people look at the NIKE site. Mr. Menn and I met last week with someone and will be meeting again in a couple of weeks. If there is an opportunity to build something and get some tax revenue we need to look at it.

 

Mr. Hoefle: Would this also include property we acquired on Plymouth and Shelton?

 

Mayor Morley:  The property on Courtland has already been bid out three times.

 

Mr. Klammer: I will have to check.

 

Mayor Morley: There has been no interest on Courtland.  We had a builder who wants to build houses in the City.

 

Mr. Hoefle:  I had one resident who was inquiring but you were talking about having to go out for bid.

 

Mr. Klammer: I think when they see that Mr. Menn is in the Building Department it will help.

 

Upon review, the Committee agreed to move this matter forward to the next regular Council meeting.
